• Project details: project type (for example, a remodel, renovation, or new custom home), estimated budget range, desired timeline, property ownership status, location, design preferences, and other details you share about your project.
• Referral partner information: if you are a real estate agent, architect, interior designer, or other referral partner, your name, business name, license or professional details, contact information, and the information you provide about the clients you refer (with their permission).
• Communications: the content of your emails, text messages, phone calls, voicemails, and messages sent through our website or social media pages.
• Scheduling information: the date, time, and notes associated with calls or consultations you book with us.

Information collected automatically

When you visit our website or open our emails, we and our service providers may automatically collect certain technical information, including your IP address, browser type, device type, operating system, pages viewed, links clicked, referring website, the date and time of your visit, and general location (city or region) derived from your IP address. We collect this information using cookies, pixels, and similar technologies (see Section 7).

Information from other sources

• Protect the security of our Services and prevent fraud or misuse; and
• Comply with legal obligations, enforce our agreements, and protect our legal rights.

3. Text Messaging (SMS) Program

If you provide your mobile phone number and agree to receive text messages from us (for example, by checking a consent box on one of our forms), you consent to receive recurring text messages from Next Level Home Performance at the number provided. These messages may include responses to your inquiry, appointment confirmations and reminders, project updates, and occasional follow-ups or promotional messages. Messages may be sent using automated technology.

• Consent is not a condition of purchase. You do not have to agree to receive text messages to do business with us.
• Message frequency varies based on your inquiry and project activity.
• Message and data rates may apply according to your mobile carrier plan.
• To opt out, reply STOP to any message. You will receive one final message confirming that you have been unsubscribed, and we will send no further texts unless you opt in again.

• Carriers are not liable for delayed or undelivered messages.

Your mobile information is never shared for marketing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories of sharing described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, except with the service providers that help us deliver our text messages.

4. Email Communications

If you submit a form or otherwise share your email address with us, we may send you emails about your inquiry, your project, or our services. Every marketing email includes an unsubscribe link, and you may opt out at any time. Even after you opt out of marketing emails, we may still send you transactional or relationship messages, such as appointment confirmations or communications about an active project.

5. How We Share Your Information

We do not sell your personal information. We share personal information only as described below:

• Service providers. We use trusted third-party vendors that perform services on our behalf, such as customer relationship management (CRM) and marketing automation, email and text message delivery, website hosting, online scheduling, analytics, payment processing, and IT support. These providers may use your information only to provide services to us.
• Project partners. When needed to complete your project, we may share relevant details with architects, designers, engineers, subcontractors, suppliers, and permitting authorities working on your project.
• Referral partners. If you were referred to us by a partner, we may share limited status information with that partner (for example, whether your project is moving forward) so that we can administer referral commissions. We do not share your budget, financial details, or private communications with referral partners without your permission.
• Legal and safety reasons. We may disclose information if required by law, subpoena, or court order, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
• Business transfers. If we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction, subject to this Privacy Policy.
• With your consent. We may share information for any other purpose with your permission.

6. Social Media

We maintain pages on social media platforms such as Facebook and Instagram. When you interact with us on those platforms, the platform's own privacy policy governs how it collects and uses your information. Information you send us through those platforms (such as messages or lead forms) is handled by us in accordance with this Privacy Policy.

7. Cookies and Tracking Technologies

Because there is no uniform standard for "Do Not Track" browser signals, we do not respond to them separately.

8. How Long We Keep Your Information

Construction project records may be retained for longer periods as required by California law. When information is no longer needed, we delete or de-identify it.

We use reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, loss, misuse, or alteration, including access controls and encrypted connections on our website. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

10. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the "CCPA"), gives you the following rights regarding your personal information, subject to certain exceptions:

Categories of personal information collected in the past 12 months: identifiers (such as name, email, phone number, address, and IP address); commercial information (such as project details, budget range, and services requested); internet or other electronic network activity (such as website browsing and email engagement); general geolocation data; audio or electronic information (such as call recordings or voicemails, where applicable); and professional information (for referral partners). We collect these categories from the sources and for the purposes described in Sections 1 and 2, and disclose them for business purposes to the categories of recipients described in Section 5.

We will verify your request by matching the information you provide with the information we have on file. You may use an authorized agent to submit a request on your behalf; we may require proof of the agent's authorization and verification of your identity. We will respond within 45 days, and may extend this period by another 45 days where permitted by law, in which case we will let you know.

California "Shine the Light" law. California Civil Code Section 1798.83 allows California residents to request information about the disclosure of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.

11. Children's Privacy

Our Services are intended for adults and are not directed to children under 16. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact us and we will delete it.

12. Links to Other Websites

Our website may contain links to third-party websites, such as social media platforms, supplier sites, or partner websites. We are not responsible for the privacy practices of those websites, and we encourage you to read their privacy policies.
